Changes to Peaceful Bay Holiday Cottage Leases

At the meeting held in June 2021, Council resolved to advertise its intention to create a new policy to enable new 21-year leases to be requested by the lessee, in the following circumstances.

1. Assignment of Lease (sale);
2. Assignment of Lease – on bequeathment; or
3. Upon the completion of substantial development of the premises (valued over $50,000).

Prior to proceeding to adopt the policy, Council is seeking comments from the public regarding the proposal.

The Shire has 203 “holiday cottage” leasehold lots at Peaceful Bay that were last renewed for 21 years in 2010 and all expire in 2031.

The Shire has had a request for Council to consider allowing people who purchase a lease, are bequeathed a lease or invest substantial capital into the premises, have adequate security of their tenure.

Comments on the proposal need to be in writing and received by the Shire of Denmark by 4pm, Friday 20 August 2021.
